Subject: Restoration of seniority of Executive Engineers (E) issued vide Government order No: 292- PDD of 2010 dated: 16-10-2010 from serial No. 1 to 67.

 

Circular No:  01- PDD/ 2012

Whereas, in pursuance of Government order No- 292- PDD of 2010  dated 16-10-2010, final seniority list of Executive  Engineers (Electric), Degree Holders of Power Development Department was  issued/ notified ;  Whereas, 189 Executive Engineers were assigned seniority positions in pursuance of the aforesaid Government order;

 

 Whereas, seniority list issued vide Government order No: 292-PDD of 2010 dated 16-11-2010  was kept in abeyance  in consultation with Law Department vide Government Order No:172- PDD of 2011 dated 27-05-2011 in view of its being challenged by some in-service officers viz-a-viz the seniority positions assigned to them and the conflict between the Reserve Category  Candidates promoted on the basis of Reservations Rules before General Category candidates in the seniority of Executive Engineers(E);

 

Whereas, SWP No. 757/2007 titled Abdul Rashid & Ors Vs State & Ors was  filed in the Hon’ble Court by S/Sh Abdul Rashid, Tariq Masood Shaiq, Mushtaq Ahmed Shah, Manzoor Ahmad Salroo and Gul Ayaz and arrayed the State of J&K through Chief Secretary and PDD as respondents and Sonam Gailson, Asgar Ali and Chering Dorjay as private respondents relating to the fixation of inter-se-seniority of reserved category candidates viz-a viz the general category candidates who were otherwise senior to them in the feeding category and orders were passed by the Hon’ble Court  on 10.09.2007, the operative part of which is as follows:-

 

“Thus on the basis of Ajit Singh’s case (supra) I find the petitioners will rank senior to the private respondents despite the fact that the respondents-reserved category candidates were promoted before the petitioners as Executive Engineers. Their promotion as Superintending Engineers on I/C basis will not give them a preferential right to claim the post of Chief Engineer.

 

In the circumstances I find due force in the present petition, the same is allowed. The petition is disposed of with the direction to the respondents that for regularization as Executive Engineer/ Superintending Engineer or for promotion as Chief Engineers on Incharge basis the petitioners shall be treated senior to the private respondents”.

 

 Whereas, the State Government feeling aggrieved of the aforesaid order filed appeal with the concurrence of the Law Department for setting aside the said judgment. The Hon’ble Division Bench after arguments passed the following order on 17.3.2008:-

 

“ Status quo be maintained for a period of one month”.

 Whereas, another LPA No. 217 of 2007 was filed by the proforma respondents who belong to ST category which was clubbed with LPA No. 212/2007 and by way of another Interim order status quo order dated 17.3.2008 was extended till the matter is considered by the Court. On 28.7.2008, the aforesaid LPA No. 212 / 07 , clubbed with LPA No. 217/2007 alongwith connected CMPs were listed before the Hon’ble Division Bench and the following orders were passed:-

 

 “CMP No. 180/08 is allowed and the applicant is allowed to intervene.

Learned Advocate General submits that a few posts of Chief Engineers are due to be filled up in PDD and allied concerns. Learned Advocate General also assured that claims of all eligible persons including the writ petitioners and contesting respondents will be considered for appointment to the post of Chief Engineer in accordance with rules. However, the posts so filed up shall be subject to final outcome of this appeal. The issue regarding seniority etc. shall be finally decided by this court.

Post after four Weeks”.

 Whereas, some retired officers of the Power Development Department have represented for their regularization/ confirmation at higher positions  of Superintending Engineer’s / Chief Engineer’s / Development Commissioner, Power etc, against available vacancies in the Power Development Department for which they might have worked in past;

 

Whereas, the matter was examined in the Department and accordingly referred to  Law, Justice and Parliamentary Affairs Department for seeking their opinion as to whether Government order No: 172- PDD of 2011 dated : 27-05-2011 whereby the seniority list of Executive Engineers of PDD ( issued vide Government order No: 292- PDD of 2010 dated 16-11-2010) was kept in abeyance can be modified/ changed to the extent that the seniority list only from Serial  No. 68 onwards be kept in abeyance so that process of regularization in respect of retired officers from seniority No. 1 to 67 be initiated as there are no inter-se-seniority dispute upto S. No. 67 and are not party to the writ;

 

Whereas, the Law, Justice and Parliamentary Affairs Department vide their U.O No: LD(Ser) 2011 / 14-PDD dated 18.10.2011 , opined as under:-

 “With the advice that the department can file application before the Hon’ble Court for seeking modification of the order to the effect that the officers figuring at serial No. 1 to 67 of the seniority list may be permitted to be segregated for purposes of issuance of a separate seniority list as they have no clash of interest with the officers who are party to the list, pending before the Hon’ble Court”.

 

 Whereas, on the basis of above opinion from Law Department, CMP alongwith draft affidavit  was filed in the Hon’ble Court  regarding finalization of the seniority of Executive Engineers who have already retired from service and are not party to the writ and whose seniority was not subject matter of challenge in the pending litigation. Whereas, the CMP filed by the department regarding finalization of the seniority of Executive Engineers who have already retired from service  and are not party to the lis and whose seniority was not subject matter of challenge in the pending litigation has been allowed subject to the condition that basic material of the judgment dated 10.9.2007, passed in SWP No. 757/ 2007 titled Abdul Rashid & Ors Vs State & Ors is required to be maintained subject to the condition that the respondents 1 to 5 as well as 6 to 8 be given an opportunity of hearing while attempting to finalize the seniority of such of those retired Executive Engineers who are not party to the lis;

 

Whereas, in terms of above directions of the Hon’ble Court as well as the opinion of the Law Department,  the department has been allowed to segregate the seniority of Executive Engineers (E) by way of modifying/ restoring  Government order No: 292- PDD of 2010 dated: 16-11-2010 to the extent of keeping the seniority in abeyance only from serial No. 68 onwards as Executive Engineers from serial No. 1 to 67 , having no clash of interest with the officers who are party to the list subject to the condition  that all the respondents who are party to the lis shall be given an opportunity of hearing;

 

Now , therefore,   the Government intends to restore  Government Order No: 292- PDD of 2010 dated 16-11-2010 from serial No. 1 to 67 , who are all retired officers and have no clash of interest and are not party to the lis and forming Annexure “A” to this circular is hereby notified for information of following respondents:-

Any respondent aggrieved with the seniority positions assigned to retired officers from serial No. 1 to 67 , may submit  objections if any, to the Power Development Department, (HRM, Branch)  Civil Secretariat, Jammu / Srinagar,  within a period of 15 days from the date of the issuance  of this Circular. Objections, if any, will not be entertained after the expiry of the stipulated time.
